Terms and Conditions governs the contractual relationship between the provider of a service and its user. The Terms and Conditions are a contract in which the owner clarifies the conditions of use of its service. The terms and conditions details the rules that apply to fulfil a particular contract and that form an important part of that contract. Both parties must agree to the Terms and conditions which provide clarity about what should happen in any given situation. It sets out the key commercial terms that the owners are offering to their clients and helps the contractual parties to understand their duties, rights, roles and responsibilities of the terms and conditions to form a contract. Please read the Terms and Conditions carefully as these conditions incorporate the basis on which bookings of POOBONG TEA GARDEN RESORT depends. By using this Site, you agree to be bound by these terms and conditions. We may revise these terms & conditions from time to time .The revised terms will take effect when they are posted. Use of some parts or features of the Site may be governed by additional terms and conditions. Where this is the case you will be notified accordingly of those additional terms and conditions.

The Terms and Conditions apply for hotel accommodation contracts as well as for all other supplies and services provided by the Resort to the guest.
1. Our Resort accommodation agreement is entrenched when a guest booking inquiry is responded to with a booking confirmation from the Resort.
2. The contractual partners are the Resort and the guest. When a third party undertakes the booking for the guest, as the customer it, along with the guest, will be liable as joint debtors to the Hotel for all obligations arising from the contract, provided the Resort has possession of a corresponding declaration from the customer. Irrespective of this, every customer is obliged to pass on to the guest all information relevant to the booking, particularly these Terms and Conditions.
3. In case of Sub-contracting or sub-letting of rooms, together with their use for any purposes other than accommodation, require the prior written approval of the Resort.
4. The Resort is entitled upon conclusion of the contract or subsequently to request a reasonable advance payment or security deposit from the guest. The due date and the advance payment may be agreed in writing in the contract. The resort is furthermore entitled at any time to request payment for the costs incurred to that time by the guest by issuing an interim invoice and to demand its immediate settlement.
5. The guest of the Resort is entitled to set off counterclaims against the claims of the Resort, if these counterclaims are undisputed or have been confirmed by way of a final legal judgement.

ARRIVAL AND DEPARTURE
The Resort reserves the right to charge an early departure fee in the event a guest departs earlier than the original departure date.
1. Provision of specific rooms cannot be demanded by guests, unless the Hotel has confirmed the provisions of particular rooms in writing.
2. The rooms that the guests have reserved shall be from 3 pm onwards on the agreed day of arrival. The guest cannot demand that rooms should be provided earlier.
3. Rooms must be vacated on the date of departure and be at the Hotel’s disposal by 12 noon at the latest. The Resort may charge the day-time room rate up in case of late departure until 4 pm to compensate it for the additional use of the room and the costs incurred by way of the delayed availability of the room; from 4 pm it may charge 100% of the current full lodging price.

Cancellation Policy
Each rate booked at our Resort, is subject to a Cancellation Policy. If the guest fails to check in on the reserved arrival date will incur a penalty charge as detailed in the Cancellation Policy.We reserve the right to cancel or modify reservations under the circumstances where it appears that a customer has provided an invalid credit card, engaged in fraudulent or inappropriate pursuit, or the reservations contain or resulted from a mistake or error.We also reserve the right to cancel or amend bookings if they do not adhere to our terms & conditions. Suppose a guest chooses to shorten their stay or check out early, a penalty charge will be applied, as detailed in the Cancellation Policy associated with the rate booked. As the aforementioned booking cancellations, Poobong Resort has no obligation to guarantee new available bookings or best rates. At the time of the new reservation,a new booking at the best available rate will need to be made by the guest. While using this website, as a condition,you agree to provide proof of payment to the hotel reservations department within 48 hours of the time of booking and will indicate the reservation confirmation number on the proof of payment. For any banking fees and/or costs required to complete the bank funds transaction(s)the full responsibility rests on you. You acknowledge that the reservation may be cancelled by the hotel if proof of payment is not submitted to the hotel within the 48-hour notice period. You will be accountable for any cancellation or no show penalties that might be incurred and hereby acknowledge that booking and personal contact information provided is correct for the hotel’s validation purposes.

POOBONG RESORT CANCELLATION POLICY:
1. 30 days before guest arrival – FULL REFUND
2. 15 to 30 days before guest arrival – 50% REFUND
3. Within 15 days of Guest Arrival – NO REFUND

Pricing Errors
Poobong Resort reserves the right to cancel contracts based upon incorrect information being displayed in relation to price or service at any point in time.
Disclaimers
When you use this Website, as a condition you warrant to Poobong Tea Garden Resort that you will not use this Website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. Although Poobong Resort may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and the like on this Website, our Resort is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, slander, omission, falsehood, obscenity, pornography, danger, or inaccuracy contained in any information within such locations on the Website. Prohibition from posting or transmitting any unlawful, threatening, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Poobong Tea Resort will fully cooperate with any law enforcement authorities or court order requesting or directing to disclose the identity of anyone posting any such information or materials.

Limitation of Liability
Notwithstanding anything contained in these Terms and Conditions to the contrary, Poobong Resort shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity, arisen out of the performance or non performance of obligations under this Terms and Conditions.

Insurance 
Poobong Resort strongly recommends you purchase Comprehensive Travel Insurance. The policy include, the following coverage – loss of payment through cancellation, loss or damage to personal baggage, loss of money and medical expenses.
